Communiqué on Plastic Materials and Articles in Contact with Food: Safety Standards

Plastic Materials in Contact with Food

Within the scope of the Turkish Food Codex Communiqué on Plastic Materials and Materials in Contact with Food; “Rules to be followed in the production, processing and distribution stages of plastic materials and materials that are in contact with food, expected to come into contact with food or likely to come into contact with food” was published by the official gazette.

Some changes or regulations are made to the communiqué published by the Ministry of Agriculture and Forestry as a result of the studies carried out. On May 6, 2024, we have compiled the regulations made according to the communiqué on the amendment published in the Official Gazette;

1. Paragraph (a) of the fifth paragraph of the fifth paragraph of Article 5 of the Turkish Food Codex Communiqué on Plastic Materials and Articles in Contact with Food (Communiqué No: 2019/44) published in the Official Gazette dated 25/12/2019 and bis numbered 30989

“All salts of authorized acids, phenols or alcohols; aluminum, ammonium, barium, calcium, cobalt, copper, iron, lithium, magnesium, manganese, potassium, sodium and zinc“ has been amended as ‘All salts of substances shown as ’yes” in column 2 of Table 1 in Annex-2 for authorized acids, phenols or alcohols and subject to the restrictions specified in columns 3 and 4 of the same table”.

2. Annex-1, Annex-2, Annex-3 and Annex-4 of the same Communiqué have been amended.

Annex-4 2.1.3 Details have been added to the contact conditions for the use of food analogs so that if the plastic material intended for contact with food is to be used as part of a food processing device, its suitability in this device can be assessed. The same details are available in the EU.

2.1.The number of metals has been increased from 9 to 24. 19 of them have a limit.

2.2. Detection limits have been set for PAA. Primary aromatic amines (PAAs) for which no migration limit has been set in Annex-1 Table 1 of this Communiqué and which are listed in Entry 43 in Annex-17/AnnexVIII of the Regulation on Registration, Evaluation, Authorization and Restriction of Chemicals published in the Official Gazette dated 23/6/2017 and numbered 30105 Repeated Edition, may not migrate into food or food analogs. When each aromatic amine is tested with an analytical device with a detection limit of 0.002 mg/kg, taking into account the third paragraph of Article 7, none of them may migrate into food or food analogues, but the migration of the sum of these primary aromatic amines into food or food analogues may not exceed 0.01 mg/kg.”

2.3. New total migration test condition established - TM0

2.4. Phthalate limits have been reduced. They are in line with the current EU limits.

3. “Harmonization process TEMPORARY ARTICLE 2- (1) Workplaces that produce, import and sell the products covered by this Communiqué are obliged to comply with the amendments made with the publication of the Communiqué introducing this article until 1/1/2026. (2) Products that do not comply with the amendments made with the Communiqué introducing this article but were placed on the market before 1/1/2026 can be on the market until 1/1/2028.” A provisional article has been added.
