Legal and Environmental Risks of RoHS Non-Compliant Products

What is RoHS?

RoHS (Restriction of Hazardous Substances) is a regulation set by the European Union that limits the use of hazardous substances. RoHS, which stands for “Restriction of the use of certain hazardous substances in electrical and electronic equipment”, was adopted by the European Parliament in 2003 and entered into force in 2006.

This regulation limits the use of certain hazardous chemicals to protect human health and the environment. The regulation, originally known as RoHS 1, has been updated over time and expanded as RoHS 2 and RoHS 3.

What is a RoHS Compliant Product?

A RoHS compliant product is a product that does not contain the specified hazardous substances or contains them below the permitted limits. The main substances restricted under the Regulation are:

  • Lead (Pb) - less than 0.1
  • Mercury (Hg) - less than 0.1
  • Cadmium (Cd) - less than 0.01
  • Hexavalent Chromium (Cr6+) - less than 0.1
  • Polybrominated Biphenyls (PBB) - less than 0.1
  • Polybrominated Diphonyl Ethers (PBDE) - less than 0.1
  • Phthalates (DEHP, BBP, DBP, DIBP) - less than 0.1

Manufacturers should strictly audit the supply chain to ensure RoHS compliance and verify the conformity of products with certificates from independent testing laboratories.

Legal Consequences of RoHS Non-Compliant Products

Products that are not RoHS compliant are prohibited from entering the European market. There can be serious legal consequences for manufacturers and distributors if a product does not comply with RoHS standards:

  • Market Bans: Non-compliant products cannot be sold in Europe.
  • Heavy Fines: High fines can be imposed if non-compliance is found.
  • Recall and Destruction: RoHS non-compliant products placed on the market must be recalled and destroyed.
  • Damage to Brand Image: RoHS non-compliance indicates that the brand is not fulfilling its environmental and ethical responsibility and may result in loss of customer trust.

Environmental Risks of RoHS Non-Compliant Products

RoHS non-compliant products can cause serious harm to the environment and human health. Here are some environmental risks:

  • Soil and Water Pollution: Heavy metals can contaminate soil and water resources when released into the environment.
  • Harm to Human Health: Heavy metals such as lead and mercury can cause serious health problems when inhaled or ingested.
  • E-waste Problem: Failure to properly dispose of RoHS non-compliant products increases the problem of electronic waste (e-waste).
  • Harm to Biodiversity: Harmful substances can leach into water and soil, damaging ecosystems.
